Definitions
- Agile Advantage: The website, platform, and service provider offering the Services.
- Member: Any person who creates an account or otherwise uses the Services, including prospective, current, and former members/clients.
- Services: Collectively, the Agile Advantage website, memberships, coaching services, courses, community features, messaging, and booking functionality.
- Personal Data: Any information relating to an identified or identifiable natural person, as defined under GDPR.
- Account Deletion (GDPR Erasure): A permanent process intended to delete or anonymize Personal Data to the extent required by applicable law; irreversible once completed.
- Account Deactivation: A reversible service action that disables access while retaining account data for potential reactivation, subject to applicable retention requirements.
- Third-Party Processors: Service providers that process data on behalf of Agile Advantage (e.g., payment processors, email providers, scheduling, video conferencing, hosting).
Acceptance of Terms
These Terms of Service (“Terms”) govern a Member’s access to and use of the Services. By accessing or using the Services, you agree to these Terms.
Services
Agile Advantage provides coaching, educational content, courses, and community features. The Services are informational and educational and are not medical, legal, financial, or mental health advice.
Eligibility
You must be at least 18 years old to use the Services.
Accounts
You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
Memberships and Payments
Membership access is managed through Paid Memberships Pro. Payments are processed by Third-Party Processors. Pricing, billing cadence, and included features are disclosed at checkout and/or on relevant sales pages.
Refunds
Unless explicitly stated otherwise at checkout or in a written offer, fees for digital access and coaching services are non-refundable once access is granted or services are delivered.
Coaching Sessions and Scheduling
Sessions are scheduled through our booking system and delivered via Zoom or similar tools. Attendance, rescheduling, and cancellation rules are governed by the policies presented during booking and confirmation notices.
Community Conduct
Members must engage respectfully and comply with posted community guidelines. Agile Advantage may moderate content and may suspend or terminate access for violations.
Intellectual Property
All content and materials provided through the Services are owned by Agile Advantage or its licensors and may not be reproduced, distributed, or resold without written permission.
Disclaimers and Limitation of Liability
No specific outcomes are guaranteed. To the maximum extent permitted by law, Agile Advantage disclaims warranties and limits liability for indirect or consequential damages.
Termination
A Member may cancel according to the account and billing tools provided. Agile Advantage may suspend or terminate access for breach, misuse, or legal compliance.
Governing Law
These Terms are governed by the laws of Agile Advantage’s primary place of business, unless otherwise required by applicable law.
